Housing Discrimination Red Flags
Housing discrimination is unfair treatment based on race, religion, sex, disability, or other protected traits. It includes things like denying a mortgage, refusing to rent or sell, or charging more — all based on who someone is, not their qualifications. While the Fair Housing Act makes this illegal, it still happens. That’s why it’s important for buyers and renters to recognize and report it. Here are some signs to watch for:
A mortgage lender who isn't upfront about mortgage rates
Transparency is key in any lending relationship. If a lender avoids giving clear info on rates or delays sharing details, it could be a sign they’re charging you more than others — possibly due to bias. Always ask for written rate estimates and compare them across multiple lenders.
A real estate agent who refuses to represent you.
If an agent won’t work with you without a valid reason, it could be discrimination — especially if it’s based on your identity, relationship, or appearance. Agents are supposed to serve all clients equally. Trust your gut and document the interaction if something feels off.
A seller or real estate agent who refuses to consider your bid, or who suddenly declares the house off the market.
If your offer is competitive but is ignored without explanation — or the home is mysteriously “no longer available” after you show interest — it could be a sign of discrimination. Sellers and agents can’t legally reject offers based on who you are. Keep records and don’t hesitate to ask questions.
If you and your partner must work harder to get financing, or pay more for it, compared with heterosexual couples.
If you are turned away from certain rental properties, even when there’s a vacancy.
Being told a unit is “no longer available” — while listings stay active or others are shown the space — can be a subtle but common form of housing discrimination. If it happens repeatedly or without a clear reason, it’s worth documenting and reporting. Everyone deserves fair access to housing.
